Being rejected planning from the council can be tough when wanting to make changes to your project. This can often lead to failure to adhere to planning permission or comply with the details which is commonly known as “planning breach”.
Planning breach can also occur when:
- Any building or development activities take place without necessary planning permission
- Failing to meet limitations attached to planning permission
A planning breach is not illegal and the council will often permit a contemplative application where planning permission has not been sought.
Nonetheless, if the planning breach involves previously rejected development (or the contemplative application fails) the council can issue an enforcement notice requiring you to change things back to how it was previously.
